1. Who we are
These Terms of Service (“Terms”) govern access to and use of the Playlith website and related online services (“Service”) offered by the legal entity identified in our Imprint. References to “we”, “us”, or “our” mean that operator.
2. The Service
Playlith helps users discover and organise multiplayer game parties and related coordination. The Service may integrate with third-party platforms (including Discord) and display information about video games owned by their respective publishers. We do not provide the games themselves, in-game items, or official support for third-party products.
3. Eligibility and accounts
You must be able to enter into a binding contract under the laws that apply to you and meet any minimum age required in your country to use the Service. Where the Service is not directed at children, you confirm that you meet the applicable age threshold.
Access to certain features may require signing in via Discord or another authentication method we enable. You are responsible for maintaining the confidentiality of your credentials and for activity that occurs under your account, except where caused by our gross negligence or wilful misconduct.
4. Acceptable use
You agree not to:
- use the Service in violation of applicable law or third-party rights;
- harass, threaten, defraud, dox, stalk, or discriminate against others;
- post or solicit unlawful, hateful, sexually explicit involving minors, or malware-related content;
- attempt to probe, scan, or test the vulnerability of the Service, or breach security or authentication;
- scrape, spider, or harvest data from the Service at scale without our prior written consent;
- misrepresent your identity, manipulate ratings or listings, or circumvent technical limits;
- use the Service to send unsolicited bulk communications.
We may investigate suspected violations and cooperate with law enforcement where permitted by law. We may suspend or terminate access if we reasonably believe you have breached these Terms or pose a risk to the Service or other users.
5. User content
You retain rights in content you submit (such as party titles or descriptions). By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, display, and distribute that content solely to operate, improve, and promote the Service.
You represent that you have the rights needed to grant the licence above. We may remove content that violates these Terms, applicable law, or our policies, or that we reasonably consider harmful to the community.
6. Third-party services
The Service may link to or interoperate with third-party services (for example Discord, game platforms, or payment providers). Those services are governed by their own terms and privacy notices. We are not responsible for third-party services and do not endorse them unless expressly stated.
Our website and application workloads are hosted on infrastructure operated by Hetzner Online GmbH (Germany). Usage statistics on our website may be collected using Google Analytics as described in our Privacy Policy.
7. Optional paid features (Stripe)
Paid subscriptions or one-time purchases, where offered, are processed by Stripe (Stripe Payments Europe Ltd and, where applicable, Stripe, Inc. and affiliates). By completing a payment, you also agree to Stripe’s terms and privacy policy to the extent they apply to your transaction. Price, billing cycle, renewal, and tax display will be presented at checkout.
Unless mandatory consumer law provides otherwise, fees are non-refundable except where we expressly agree or where required by law. Chargebacks and payment disputes are handled under Stripe’s rules and the rules of the relevant payment networks, in addition to these Terms.
8. Availability and changes
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where practicable.
We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Where changes are material and required by law, we will provide additional notice. Continued use after the effective date constitutes acceptance of the updated Terms, to the extent permitted by law.
9. Disclaimers
To the fullest extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by applicable law, we and our affiliates, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our aggregate liability for claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the three months before the event giving rise to liability, or (b) fifty euros (€50), except where liability cannot be limited under mandatory law (for example in cases of personal injury caused by negligence, or fraud).
11. Indemnity
You will defend, indemnify, and hold harmless the operator and its personnel from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the Service, or your breach of these Terms, except to the extent caused by our gross negligence or wilful misconduct.
12. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. If you are a consumer habitually resident in the European Economic Area, you also benefit from mandatory provisions of the law of your country of residence. Nothing in these Terms limits rights that cannot be waived under applicable consumer law.
Unless mandatory law provides otherwise, exclusive place of jurisdiction for disputes arising from these Terms is the seat of the operator identified in the Imprint. For consumers in the EEA, the statutory jurisdiction rules may also apply.
